Except where permitted by applicable law or expressly authorized by American Horizon Media LLC, users may not systematically collect, scrape, copy, download, or use substantial portions of our original photographs, videos, audio, written materials, graphics, or other proprietary content for the purpose of creating, training, fine-tuning, developing, or supplying datasets to generative artificial intelligence or machine-learning systems.

This provision does not restrict lawful indexing by ordinary search engines or uses that cannot legally be restricted.

7. User Submissions

Our website may allow you to submit information or materials through contact forms, booking forms, applications, surveys, order forms, uploads, reviews, messages, or other interactive features.

You retain ownership of materials that you own and submit to us.

By submitting material, you represent that you have the right and authority to provide it to us and that our use of it for the purpose for which it was submitted will not unlawfully infringe the rights of another person.

Submitting a contact form, quote request, booking request, or other inquiry does not by itself guarantee availability or create a binding service agreement.

A booking is not considered confirmed solely because an inquiry or form was submitted unless we expressly state otherwise.

Service dates, pricing, deposits, payment schedules, cancellations, rescheduling, deliverables, licensing, turnaround times, client responsibilities, event requirements, and other project-specific terms may be established in a separate written agreement.

Where a signed service agreement applies, that agreement controls the applicable project.

10. Products and Online Store Purchases

We may offer physical or digital products through our websites, including merchandise, prints, photographs, creative products, and other items.

Product images and descriptions are intended to provide a reasonable representation of the item. Actual colors, dimensions, placement, appearance, or other characteristics may vary because of screens, manufacturing processes, printing methods, materials, or other production factors.

We reserve the right to correct errors and to modify or discontinue products, subject to applicable law and obligations for orders already accepted.

We may limit quantities or decline an order where reasonably necessary to prevent fraud, correct an error, address inventory issues, or comply with applicable law.

11. Pricing, Taxes, and Payment

Prices are displayed in the currency indicated on the website.

Applicable sales tax, shipping charges, processing charges, or other disclosed charges may be added during checkout when applicable.

Unless a different license accompanies the product, digital products purchased from us are for the purchaser's personal or expressly authorized use and may not be redistributed, resold, sublicensed, uploaded for public distribution, or presented as the purchaser's own work.

14. Promotions, Discounts, and Special Offers

Promotional offers, coupons, discount codes, giveaways, contests, special pricing, or limited-time offers may be subject to additional conditions.

24. Indemnification

To the extent permitted by applicable law, you agree to indemnify and hold harmless American Horizon Media LLC and its officers, employees, contractors, and representatives from third-party claims, damages, liabilities, and reasonable costs arising from:

  • your unlawful use of the website

  • material you submit without necessary rights or authorization

  • your infringement of another person's intellectual-property or other legal rights

  • fraud or intentional misconduct committed through our website

  • your material violation of these Terms

This provision does not require a consumer to indemnify American Horizon Media LLC for the company's own unlawful conduct or for liability that cannot legally be shifted to the consumer.

25. Fraud and Unauthorized Transactions

We may take reasonable steps to verify orders, bookings, submissions, payment information, identities, or account activity when fraud, unauthorized use, or misuse is reasonably suspected.

The remaining provisions will continue in effect.

They do not replace a separate signed contract, invoice terms, license, release, booking agreement, or other written agreement governing a particular project or transaction.

Any dispute concerning these Terms will be handled by a court or other forum having lawful jurisdiction over the parties and the dispute.

Nothing in these Terms is intended to prevent a consumer from exercising rights concerning jurisdiction, venue, administrative complaints, or legal remedies that cannot lawfully be waived.

30. Changes to These Terms

We may revise these Terms periodically to reflect changes in our website, business operations, services, technology, or legal obligations.

The current version will be posted on our website with an updated “Last Updated” date.

Changes apply prospectively from their effective date unless otherwise required or permitted by law.

Continued use of the website after revised Terms become effective constitutes acceptance of the revised Terms to the extent permitted by applicable law.
